1. Agreement to Terms
By accessing and using Constant Sentinel's website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.
2. Service Description
Constant Sentinel provides automated DBS (Disclosure and Barring Service) monitoring for organisations. Our service includes:
- Automated weekly DBS checks against the DBS Update Service
- Real-time alerts when staff criminal record status changes
- Immutable audit trails for compliance
- Admin dashboard for organisation management
3. User Responsibilities
You agree to:
- Provide accurate and complete organisation and employee information
- Maintain confidentiality of your login credentials
- Use the service only for lawful purposes
- Comply with UK data protection and employment law
- Not attempt to breach or circumvent security measures
- Notify us immediately of unauthorized access
4. Licensing and Use
We grant you a limited, non-exclusive license to use our service for your organisation's internal use only. You may not:
- Resell or redistribute the service
- Reverse engineer or decompile our software
- Use the service to compete with Constant Sentinel
- Access the service with automated tools (scrapers, bots, etc.)
5. Data Protection & Compliance
You acknowledge that you are responsible for:
- Obtaining lawful consent from employees to conduct DBS checks
- Complying with UK GDPR and Data Protection Act 2018
- Ensuring fair and lawful processing of personal data
- Meeting KCSIE 2026 and safeguarding requirements
Constant Sentinel is a Data Processor. You are the Data Controller and remain responsible for lawful data handling.
6. Pricing and Payment
Pricing is based on the number of enrolled employees and organisation size. You agree to:
- Pay invoices within the agreed terms (typically 30 days)
- Notify us of billing changes
- Accept price adjustments with 30 days' notice
7. Service Level & Uptime
While we strive for 99.5% uptime, we do not guarantee uninterrupted service. We are not liable for:
- Scheduled maintenance
- External service outages (DBS API, internet providers)
- Force majeure events
8. Limitation of Liability
To the maximum extent permitted by law:
- Constant Sentinel is provided "as is" without warranties
- We are not liable for indirect, consequential, or punitive damages
- Our total liability shall not exceed amounts paid by you in the preceding 12 months
9. Termination
Either party may terminate the service with 30 days' written notice. Upon termination:
- Your access will be disabled
- Data will be retained per UK law requirements
- You remain responsible for any outstanding invoices
10. Acceptable Use Policy
You agree not to:
- Use the service for unlawful purposes
- Harass, defame, or discriminate against individuals
- Attempt to gain unauthorized access
- Transmit malware or harmful code
- Interfere with service performance
11. Indemnification
You agree to indemnify and hold harmless Constant Sentinel from any claims arising from:
- Your use of the service
- Your violation of these terms
- Your violation of applicable law
- Your processing of personal data
12. Governing Law
These Terms are governed by and construed in accordance with English law. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
